Terms of Service

Please read these terms of service carefully before using Portsmouth Lawn Care's services. By requesting or accepting our lawn care and landscaping services, you agree to be bound by these terms and conditions.


1. Service Agreement

Portsmouth Lawn Care ("Company," "we," "us," or "our") agrees to provide lawn care and landscaping services ("Services") to you ("Customer," "you," or "your") in accordance with the terms and conditions outlined in this agreement.

All service requests and quotes are subject to acceptance by Portsmouth Lawn Care. A service agreement is formed when you accept a written estimate or schedule a service appointment with our team. The specific services to be provided will be detailed in the written estimate or service agreement provided to you.

Services are provided on a one-time, recurring weekly, bi-weekly, monthly, or seasonal basis as agreed upon in writing. The scope of work, frequency of visits, and pricing will be clearly outlined in your service agreement.

2. Limitation of Liability

Portsmouth Lawn Care is fully insured and maintains comprehensive general liability coverage. However, you acknowledge and agree that the Company is not responsible for:

  • Damage to underground utilities, sprinkler systems, or buried cables not marked or disclosed prior to service
  • Damage to vehicles, structures, or personal property not caused by negligence or willful misconduct by our crew
  • Injury to pets or wildlife on your property
  • Natural events such as frost, drought, disease, or pest infestations affecting your lawn or landscape
  • Damage caused by weather events, flooding, or acts of God occurring after our service
  • Results of lawn care services on lawns in poor condition, stressed by disease, or damaged prior to service

Our liability is limited to the amount paid for the specific service that caused the damage, not to exceed the service cost. In no event shall Portsmouth Lawn Care be liable for indirect, incidental, consequential, or punitive damages.

You agree to maintain appropriate insurance coverage for your property and to notify us of any hazards, underground utilities, or special concerns before service begins.

3. Payment Terms and Billing

Pricing: All pricing is based on the written estimate provided by Portsmouth Lawn Care. Prices are valid for 30 days from the date of the estimate. Prices may be adjusted annually at the beginning of each service season.

Payment Methods: We accept payment via credit card, debit card, ACH bank transfer, and check. Payment is due within 30 days of invoice date unless other arrangements have been made in writing.

Recurring Services: For weekly, bi-weekly, or monthly recurring services, payment is typically due at the end of each billing period. Customers may choose to set up automatic payment through credit card or bank account to ensure timely payment.

Late Payments: Invoices not paid within 30 days will incur a late fee of 1.5% per month on the outstanding balance. Accounts more than 60 days overdue may be referred to a collection agency, and service may be suspended until payment is received.

Additional Charges: If the scope of work requested differs from the original estimate, we will provide a revised quote before proceeding. Additional services not included in the original estimate will be billed separately.

4. Cancellation and Termination

One-Time Services: One-time service appointments may be cancelled with at least 48 hours notice without penalty. Cancellations made with less than 48 hours notice may incur a cancellation fee equal to 50% of the estimated service cost.

Recurring Services: Recurring service agreements may be cancelled by either party with 14 days written notice. If cancelled with less than 14 days notice, you may be charged for the next scheduled service. No refunds will be issued for partial billing periods.

Non-Payment: Portsmouth Lawn Care reserves the right to suspend or terminate services if payment is not received within 60 days of the invoice date. Service will resume only after payment in full plus any applicable late fees are received.

Termination by Company: We reserve the right to terminate services at any time if: (1) the property or customer conduct poses a safety risk to our crew, (2) access to the property is denied or restricted, or (3) the customer engages in abusive or threatening behavior toward our staff.

Refunds: Refunds for services rendered are not available unless the Company failed to perform the agreed-upon services or failed to meet the agreed-upon service standards. Any refund claim must be submitted in writing within 14 days of service.

5. Customer Responsibilities

You agree to:

  • Provide safe and legal access to your property for our crew and equipment
  • Disclose the location of all underground utilities, sprinkler systems, septic systems, and other hazards prior to service
  • Ensure that gates, fences, and entryways are accessible unless other arrangements have been made
  • Keep pets indoors or secured away from work areas during service visits
  • Maintain your property in a condition safe for our crew to work (e.g., removing large debris, toys, or obstacles)
  • Provide accurate property information and notify us of any changes to your property or service requirements
  • Treat our crew members with respect and courtesy
  • Comply with all local laws and regulations regarding lawn care and landscaping

Failure to meet these responsibilities may result in service delays, additional charges, or termination of services.

6. Warranty Disclaimer

No Guarantee of Results: Portsmouth Lawn Care makes no warranty or guarantee regarding the results of lawn care services, including but not limited to lawn growth, color, thickness, or freedom from weeds, disease, or pests. Lawn health depends on many factors beyond our control, including weather, soil conditions, irrigation, and prior lawn care.

Service Standards: We warrant that Services will be performed in a professional and workmanlike manner consistent with industry standards for lawn care in the Portsmouth, Virginia area. If you believe our work does not meet these standards, you must notify us in writing within 14 days of service completion.

Equipment and Materials: We use commercial-grade equipment and industry-standard materials. However, we do not warrant that equipment will not cause minor damage to grass blades, turf, or landscaping during normal operation. Reasonable wear and temporary blade damage is normal and expected.

Disclaimer: EXCEPT AS EXPRESSLY STATED ABOVE, PORTSMOUTH LAWN CARE MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

7. Dispute Resolution

Notice of Dispute: If you have a concern or dispute regarding our Services, you must notify Portsmouth Lawn Care in writing within 14 days of the service date. Your notice should describe the issue in detail and include your service agreement number or address.

Resolution Process: Upon receipt of your notice, we will investigate the claim and contact you within 5 business days to discuss the issue and attempt to reach a resolution. If we believe the issue is valid, we may offer to re-perform the service at no charge or provide a partial refund at our discretion.

Informal Negotiation: Before pursuing any legal action, both parties agree to attempt to resolve the dispute through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, either party may pursue other remedies.

Governing Law: These terms and conditions are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law principles. You agree that any legal action or proceeding arising out of this agreement shall be brought exclusively in the state or federal courts located in Norfolk, Virginia.

8. Indemnification

You agree to indemnify, defend, and hold harmless Portsmouth Lawn Care, its owners, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including attorney's fees) arising from or related to:

  • Your use or misuse of the Services
  • Injury to you or third parties on your property during or after our service
  • Damage to your property caused by your failure to disclose hazards or maintain safe access
  • Your violation of any local, state, or federal law or regulation
  • Your breach of this agreement

9. Property Access and Safety

Access: By requesting our Services, you grant Portsmouth Lawn Care permission to enter your property for the purpose of performing the agreed-upon Services. You represent that you have the authority to grant this permission and that no third party has exclusive rights to the property.

Safety Precautions: Our crew will take reasonable precautions to protect your property during service. However, you acknowledge that lawn care equipment can cause minor damage to grass, soil, or landscaping, and you accept this risk as part of the normal lawn care process.

Hazard Disclosure: You must disclose all hazards on your property prior to service, including but not limited to: underground utilities, sprinkler systems, septic systems, pools, drainage systems, power lines, and any other conditions that could affect service safety or quality.

Assumption of Risk: You acknowledge that lawn care services involve inherent risks and you assume all risks associated with our work on your property.

11. Modifications to Terms

Portsmouth Lawn Care reserves the right to modify these terms of service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our Services following the posting of revised terms means you accept and agree to the changes. It is your responsibility to review these terms regularly for updates.

12. Severability

If any provision of these terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if not possible, will be severed. The remaining provisions will continue in full force and effect.

13. Entire Agreement

These terms of service, together with your written service agreement and any other documents referenced herein, constitute the entire agreement between you and Portsmouth Lawn Care regarding the Services and supersede all prior negotiations, representations, and agreements, whether written or oral.
